On behalf of Elite Recovery, LLC (“ER”), I am pleased to extend to you this conditional offer of part-time or casual employment as . Based on your skills, experience and other qualifications that you have represented to us, we are excited to have you join ER. The remainder of this letter describes the other terms and conditions of our conditional employment offer.

At-Will Employment.  Employment with ER is for an indefinite period of time.  Nothing in this offer letter modifies or is intended to modify the at-will employment relationship that we will have if you join ER.  Only an agreement in writing signed by the CEO- Drew Horowitz on behalf of ER specifically negating the at-will nature of the employment relationship may modify the at-will nature of the relationship.

Exempt Status. The position is a part-time/casual (approximately hours/week), position.

Additional Job Details:   

ER’s Policies.  Your employment will be subject to ER’s policies and procedures that we establish and may modify from time to time.

Compensation and Benefits.  Your initial compensation package will be comprised of the following components: 

    1. ER will pay you an initial salary/wage of (gross) .  ER employees are paid every two weeks the wage indicated for each hour worked during the pay period, less applicable income tax and other legally required withholding and any deductions that you voluntarily authorize in writing. We adjust pay periodically based on merit, the market for talent, ER’s finances, and other factors as ER deems appropriate.
    2. As a part-time employee, you will be eligible to to receive 0.0692 hours of paid time off (PTO) per hour worked. PTO is accrued each payroll cycle. PTO is prorated to the first day of employment and any days off from work must be approved by the company. See PTO policy for more information.
    3. As a part-time employee, you will be eligible for reimbursement for some professional development costs, including up to $100 per month for licensing supervision, $200 per year for license renewals/applications, and $150 per year for training and continuing education. Certain minimum commitments apply. 
    4. Benefits are governed by insurance contracts and benefits summaries, and the terms and conditions in those materials control.  Others are based on ER’s established policies and procedures.  Please contact Samantha LeMieur, HR Director, at samantha@drewhorowitzassociates.com if you have any questions about your package of benefits. Like other employers, we review our benefits regularly and reserve the right to add new benefits, modify existing programs, and terminate them, as we deem necessary or appropriate.  All terms and conditions of employment are subject to modification from time to time as ER’s deems necessary or appropriate.
    5. Additional benefits, if applicable:

Your Representations.  We are excited that you will become an employee of ER.  However, it is very important for both you and ER to ensure there are no conflicts or potential conflicts between you and other organizations as you work for ER.  Therefore, we require that you make the following representations to us.  If any of these present a problem for you, we would be glad to discuss them with you, but you must inform us in writing immediately if you recognize a problem.  Please note that the representations you are making below are conditions of your employment.  This offer is conditioned on the following representations:

First, by your signature below, you are confirming that you do not have a contract with any former employer that prohibits or restricts you from working for ER in any way.  This conditional offer has been made with the understanding that you do not have an agreement with a former employer or business that restricts or prohibits you from working for ER including in the position that ER has offered to you.  This includes obligations provided to you in an offer letter, employment agreement, non-competition agreement, non-solicitation agreement, or confidentiality agreement. It is our policy to not interfere with another employer’s contracts.  If you have an agreement with a former employer that restricts or prohibits you from working for ER, you must immediately inform us in writing and provide a copy of the agreement(s).

Second, you agree that you will not access, use or disclose any confidential information or trade secrets of any business other than ER (including any former employer) during your employment with ER.  This includes patient lists, sales or marketing plans, and any other information that constitutes confidential information or trade secrets.  ER will not ask you to use or disclose another employer’s confidential information or trade secrets.  Your signature below confirms that you will refrain from accessing, using, or disclosing any confidential information or trade secrets belonging to another employer during your employment with ER.

Third, you confirm that you will not use or disclose any property or documents belonging to a former employer during your employment with ER.  If you have in your possession (or under your control) any property belonging to another employer, we ask that you return it immediately and before you begin working at ER.  By your signature below, you are confirming that you do not possess property or documents belonging to a former employer and that you will not use such property during your employment with ER.

As an additional condition of employment, for purposes of completing the federal I-9 form, we require you to bring sufficient documentation to establish your identity and authorization to work.

This offer of employment is also conditioned on the Company receiving satisfactory responses on any required background studies, reference checks, and pre-employment drug testing requested.
